Privacy Policy

Our company places a high priority on the protection of personal data and respects your desire for privacy. In the following, we inform you about the collection of personal data when using our website. If there are any further questions regarding the handling of your personal data, please feel free to contact our data protection officer.

Contact

When you contact us by e-mail, the data you provide (your e-mail address, name and telephone number, if applicable) will be stored by us in order to answer your questions and process your requests. The legal basis in this respect is Art. 6 para. 1 p. 1 lit. f GDPR. Insofar as you provide us with information on communication channels (for example, e-mail address, telephone number), you also consent to us contacting you via this communication channel, if necessary, in order to respond to your request. A communication of this information is expressly on a voluntary basis and with your consent, Art. 6 para.1 p. 1 lit. a GDPR. You can, of course, revoke this consent at any time for the future.

Your data that we have received in the course of contacting you will be deleted as soon as it is no longer required to achieve the purpose for which it was collected, your request has been fully processed and no further communication with you is necessary or desired by you.

As the controller, our company has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed through this website. Nevertheless, internet-based data transmissions can generally have security gaps. Absolute protection cannot be guaranteed; in any case, sending unencrypted e-mails is not secure. We therefore ask you not to send sensitive data by unencrypted e-mail, but to use either encrypted communication channels (e.g. our contact form) or the postal service.

Your rights

We will gladly provide you with information as to whether personal data relating to you is being processed; if this is the case, you have a right to information about this personal data and to the information listed in detail in Art. 15 GDPR. In addition, you have the right to rectification (Art. 16 GDPR), the right to restriction of processing (Art. 18 GDPR), the right to erasure (Art. 17 GDPR) and the right to data portability (Art. 20 GDPR) under the respective legal conditions.

You have the right to object to processing under the legal conditions (Art. 21 GDPR).

To exercise your above rights, please contact us by e-mail to info@visiontree.com or by post to Visiontree Software, Inc., 8885 Rio San Diego Drive, Suite 220, San Diego, CA 92108. The exercise of your above rights is free of charge for you.

Without prejudice to these rights and the possibility of seeking any other administrative or judicial remedy, you may at any time exercise your right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or the place of the alleged infringement, if you consider that the processing of personal data relating to you infringes data protection law (Article 77 GDPR).

The processing of personal data can be based on various legal bases. If we need your data to fulfill a contract with you or to respond to inquiries from you regarding a contract, the legal basis for this data processing is Art. 6 para. 1 p. 1 lit. b GDPR. If we obtain your consent for certain data processing, the legal basis is Art. 6 para. 1. p. 1 lit. a GDPR. We carry out some data processing on the basis of our legitimate interest, always weighing your interests worthy of protection against our legitimate interests. The legal basis here is Art. 6 para. p. 1 lit. f GDPR. If processing is necessary to fulfill a legal obligation to which we are subject, the legal basis is Art. 6 para. 1 p. 1 lit. c GDPR.

Below, we explain how we process personal data via our website.

Data processing when calling up the website

During the mere informational use of the website, i.e., if you do not register or otherwise transmit information to us (e.g., via a contact form), we collect the following technical information (log file data). This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

The collection of this data is technically necessary to display our website to you and to ensure stability and security. We and our service provider do not regularly know who is behind an IP address. We do not combine the data listed above with other data.

The legal basis is Art. 6 para. 1 p. 1 lit. f GDPR. Since the collection of data for the provision of the website and the storage in log files are absolutely necessary for the operation of the website and to protect against misuse, our legitimate interest in data processing prevails at this point.

Data security

We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security procedures are regularly reviewed and adapted to technological progress.

Data transfer

As a matter of principle, your personal data will not be transferred to third parties unless we are legally obliged to do so, or the transfer of data is necessary for the performance of the contractual relationship, or you have previously given your express consent to the transfer of your data.

What are cookies?

Cookies are data that are stored on your computer by a website you visit and allow your browser to be reassigned. Cookies transmit information to the entity that sets the cookie. Cookies can store various information, such as your language setting, the duration of your visit to our website or the entries you have made there. This avoids, for example, that you have to re-enter required form data each time you use the site. The information stored in cookies can also be used to recognize preferences and to tailor content according to areas of interest.

There are different types of cookies: session cookies are sets of data that are only temporarily held in memory and deleted when you close your browser. Permanent or persistent cookies are automatically deleted after a predetermined duration, which may vary depending on the cookie. The information can also be stored in text files on your computer with this type of cookie. However, you can also delete these cookies at any time via your browser settings.

First-party cookies are set by the website you are currently visiting. Only that website is allowed to read information from these cookies. Third-party cookies are set by organizations that do not operate the website you are visiting. For example, these cookies are used by marketing companies.

This website does not use cookies.

Google Web Fonts (offline variant)

This site uses so-called web fonts provided by Google for the uniform display of fonts. When you call up a page, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly. We have opted for the offline variant, in which the Google Fonts are stored locally on our web server. The management of the fonts is then possible - using CSS - as with any other font family. A transmission of the IP address and other data to Google does not take place.

The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offerings with regard to efficiency and cost-saving considerations. This represents a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. If your browser does not support web fonts, a standard font will be used by your computer.

You can find more information about Google Web Fonts at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://www.google.com/policies/privacy/.

Orders

If you purchase a product or service from us, we request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

The legal basis is the conclusion and execution of a contract according to Art. 6 para. 1 p. 1 lit. b GDPR.

For payment processing, we use various payment service providers, which are always identified and accept your input. These are consequently recipients of your personal data collected in connection with the payment process. The legal basis for the involvement of payment service providers is also the execution of the contract according to Art. 6 para. 1 p. 1 lit. b GDPR.

Surveys or Contests

From time-to-time we may provide you the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information and demographic information.

We use this information to notify contest winners and award prizes, to monitor site traffic or personalize the site (in the case of anonymous information collected in surveys), to send participants email communications, and to send advertisements.

The legal basis for the data processing is your consent according to Art. 6 para. 1 p.1 lit. a GDPR. You can, of course, revoke this consent at any time for the future. Your data will be deleted after the end of the contest.

Uses of Information

If you gave us your email address, we may use it to send you newsletters, product updates, service-related information, and other offers and information from Visiontree or our business partners. Visiontree also may contact you by email to respond to any customer service inquiries you submit. We disclose your email address to business partners, advertisers, and sponsors, and to employees and agents working for or on behalf of Visiontree. We do not use your email address to correlate your identity to your Internet usage paths.

We use IP addresses to diagnose problems with our servers and to administer our Web site. Your IP address also is used by Visiontree to gather broad demographic information, such as your general geographic location and Internet Service Provider. IP addresses are further used to help determine the number of users of our Web site. This demographic information may also be used by us to analyze aggregate Internet usage behavior.

The legal basis for sending the respective newsletter is your consent according to Art. 6 para. 1 p. 1 lit. a GDPR. You can, of course, revoke this consent at any time for the future. If you do not want to receive further newsletters, offers, or product and service information, simply click the unsubscribe or opt-out link at the bottom of the unwanted email message or send an email to info@visiontree.com.

With Whom Do We Share Your Personally Identifiable Information?

Except as described below, we will not share your personally identifiable information with third parties (aside from entities that perform services for us, such as processing credit card payments), unless you have “opted-in” to such sharing. We will, however, share your name and email address with our advertisers and sponsors so that they can send you information, offers, and promotions.

However, we may disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to: (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; or (3) act in an emergency to protect someone’s safety.

We may gather demographic information from you (for example, your age, education level or household income) from time to time. We will not share such information with any other person or entity in a manner that identifies you as an individual, unless we let you know that at the time of collection or we have your permission. When we share demographic information with third parties, we will give them aggregate information only.

As we develop our business, we may buy or sell assets, and, depending upon the transaction, your personally identifiable information may be one of the transferred assets. In the event that we are acquired by another company, your personal information may be part of the assets transferred to the acquiring party.

This Web site contains links to other sites that are not owned or controlled by Visiontree. Please be aware that we are not responsible for the privacy practices of such other sites. This privacy statement applies only to information collected by this Web site.

Access to Personally Identifiable Information

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by emailing our Customer Support at support@visiontree.com or by contacting us.
